Terms and Conditions for Clip-it

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User” or “you”) and Luis Duran (“Developer,” “we,” “us,” or “our”) concerning your access to and use of the Clip-it mobile application (the “App”).

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with all of these Terms, you are prohibited from using the App and must delete it immediately.

1. Description of Service

Clip-it is a productivity tool designed to help users manage, organize, and sync their clipboard content (including text, links, images, and files) across their Apple devices. Features include custom tags, a system-wide keyboard extension, and iCloud synchronization.

2. Data Storage and Privacy

• Local and Cloud Storage: Your clips and data are stored locally on your device and synchronized via your personal Apple iCloud account.
• Developer Access: We do not host your data on our own servers. We do not have access to your clips, tags, or iCloud content.
• Security: Your data is protected by Apple’s iCloud security protocols. You are solely responsible for maintaining the security of your device and your Apple ID/iCloud credentials.

3. Critical Information and Prohibited Use

• General Productivity Only: Clip-it is intended for general productivity and organizational purposes.
• No Sensitive Data: You MUST NOT use the App to store “Critical” or “Sensitive” information. This includes, but is not limited to:
  • Passwords or login credentials.
  • Credit card numbers or financial account details.
  • Medical or health records.
  • Government-issued identification numbers.
  • Any other data that could cause significant financial, personal, or legal harm if lost, corrupted, or exposed.
• User Responsibility: You are solely responsible for the content you choose to save within the App.

4. Disclaimer of Warranties and Limitation of Liability

• “As Is” Service: The App is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, express or implied, regarding the App’s reliability, availability, or fitness for a particular purpose.
• Data Loss Disclaimer: To the maximum extent permitted by applicable law, Luis Duran shall NOT be held responsible or liable for any loss of data. Data loss can occur due to factors beyond our control, including but not limited to:
  • iCloud synchronization errors or service outages.
  • Operating system updates or hardware failures.
  • Software bugs or accidental deletion by the user.
  • Loss of access to your Apple ID.
• No Damages: In no event shall the Developer be liable for any indirect, incidental, special, or consequential damages arising out of your use or inability to use the App, even if advised of the possibility of such damages.

5. Subscriptions and Purchases (Pro Version)

• Billing: If you purchase a “Pro” or “Premium” subscription, payment will be charged to your Apple ID account at the confirmation of purchase.
• Automatic Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel your subscriptions in your App Store Account Settings.
• Refunds: All financial transactions are handled by Apple. We do not have the authority to issue refunds. You must contact Apple Support directly for any refund requests.

6. Keyboard Extension

The App includes a custom keyboard extension. To function correctly, it may require “Full Access” in iOS settings. This access is used strictly to allow the keyboard to communicate with the main App to retrieve your saved clips. We do not log, track, or transmit your keystrokes to any external servers.

7. Third-Party Services

The App utilizes third-party services (such as Apple iCloud for syncing and Google Firebase for anonymous analytics). Your use of these features is also subject to the respective terms and privacy policies of those third-party providers.

8. Intellectual Property

Luis Duran retains all rights, title, and interest in and to the App’s code, design, logos, and original content. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms within the App or on our website. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your local jurisdiction, without regard to its conflict of law principles.
