Welcome to iBorder (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your download, access, and use of the iBorder mobile application available on the Apple App Store, alongside our related software and services (collectively, the “Services”).
What this means: By downloading, installing, or using iBorder, you agree to be bound by these Terms. Please read them carefully before using the app.
1. Acceptance and Eligibility
By downloading, accessing, or using iBorder, you confirm that:
- You are at least 18 years of age (or the age of legal majority in your jurisdiction); or
- If you are between 13 and 17 years old, you access the Services solely with the active consent and supervision of a parent or legal guardian who agrees to be bound by these Terms;
- You have the legal authority to enter into this agreement; and
- You are not prohibited from accessing or using the Services under applicable local or international laws.
2. Description of Services
iBorder provides travelers, commuters, and logistics operators with border-crossing wait times, historical trends, live border camera feeds, exchange rates, customizable port tracking, wait-time alert notifications, and lock-screen Live Activities for international border crossings between the United States, Mexico, and Canada.
3. Government Data & Accuracy Disclaimer
- Independent Application: iBorder is an independent mobile application developed by Luis Duran. iBorder is not affiliated with, associated with, authorized by, endorsed by, or in any way officially connected with U.S. Customs and Border Protection (CBP), the U.S. Department of Homeland Security (DHS), the Canada Border Services Agency (CBSA), the Mexican Tax Administration Service (SAT), or any other governmental agency.
- Public Data Sources: Wait times, operational hours, and lane availability are aggregated from publicly available government feeds (including CBP border wait time datasets) and third-party municipal feeds.
- Estimates Only: All posted wait times, open lane counts, and historical projections are estimates provided for convenience and general informational planning purposes only. Actual border wait times may vary significantly due to real-time traffic volume, secondary inspections, unexpected lane closures, weather conditions, law enforcement operations, holidays, and system outages.
- No Guarantee of Travel Times: We do not warrant, represent, or guarantee that posted wait times reflect real-time on-the-ground conditions at any given moment. You are solely responsible for your travel planning, schedule, and compliance with border crossing regulations.
4. In-App Purchases, Subscriptions & Billing
4.1 Available Purchases
iBorder offers optional auto-renewable subscriptions to unlock premium functionality (iBorder Pro):
- iBorder Pro (Individual — Annual):
- Access to all premium features on your personal device: 100% ad-free experience, lock-screen Live Activities, live camera and video feeds, historical wait time analysis charts, and customizable wait time alarm notifications.
- iBorder Pro (Family — Annual):
- Full access to all Pro features with support for Apple Family Sharing, allowing up to five (5) additional family members in your Apple Family group to use iBorder Pro under a single subscription.
4.2 iCloud Account Requirement for Family Sharing and Shared Subscriptions
[!IMPORTANT] Active iCloud Account Required:
- Family Sharing: Utilizing the Family subscription tier requires that the primary subscriber and family members have an active, valid Apple ID / iCloud account signed into their iOS devices with Apple Family Sharing properly configured.
- Shared Ecosystem Subscriptions: If you access iBorder Pro through an eligible shared cross-app subscription across our developer ecosystem, an active iCloud account is required on your device. Apple’s secure infrastructure relies on iCloud and shared App Group entitlements to verify subscription validity, active family membership, and cross-app status across your devices.
4.3 Billing, Renewal, and Cancellation
- Apple ID Billing: All purchases and subscription fees are charged directly to your Apple ID account upon confirmation of purchase.
- Automatic Renewal: Subscriptions automatically renew at the end of each billing period (annual) unless auto-renew is turned off at least 24 hours prior to the conclusion of the current subscription cycle.
- Managing Subscriptions: You can manage, modify, or cancel your subscription at any time through your iOS device settings (Settings > Apple ID > Subscriptions).
- Refund Policy: All transactions, billing disputes, and refund requests are handled exclusively by Apple Inc. in accordance with Apple Media Services Terms and Conditions. We cannot process refunds directly.
5. Live Activities, Notifications & Location Services
- Location Services: iBorder may request access to your device’s location solely to calculate proximity to nearby border crossings and sort ports by distance. Location calculation occurs on-device and is never used to track your physical movement or sold to third parties.
- Push Notifications: When enabled, push notifications deliver personalized wait time threshold alerts and CBP refresh notices. Delivery may be affected by device power-management modes, cellular coverage, or operating system throttles.
- Live Activities: Lock-screen and Dynamic Island Live Activities provide glanceable lane wait times.
6. Live Camera Feeds & External Links
- Third-Party Cameras: Live video feeds and webcam snapshots displayed within iBorder are sourced from third-party public or municipal traffic monitoring systems. We do not operate these cameras and are not responsible for camera outages, video lag, distorted imagery, or discontinued camera streams.
- Map Navigation: Navigation links open third-party mapping applications (such as Apple Maps or Google Maps) governed by their respective terms of service.
7. Acceptable Use & App Integrity
You agree not to:
- Decompile, reverse engineer, disassemble, decrypt, or attempt to derive the source code of iBorder;
- Use automated scripts, scrapers, or bots to harvest data or abuse server APIs;
- Resell, redistribute, rent, lease, or sublicense the application;
- Interfere with or compromise the security or integrity of the Services.
8. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- IBORDER IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
- WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ACCURACY, COMPLETENESS, RELIABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND UNINTERRUPTED AVAILABILITY OF BORDER WAIT TIMES, LIVE CAMERAS, OR CURRENCY RATES.
- WE DO NOT GUARANTEE THAT THE APP WILL MEET YOUR SPECIFIC TRAVEL REQUIREMENTS OR OPERATE ERROR-FREE AT ALL TIMES.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IBORDER, ITS DEVELOPER, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION:
- DELAYS AT BORDER CROSSINGS OR PORTS OF ENTRY;
- MISSED FLIGHTS, TRAINS, APPOINTMENTS, OR TRAVEL ENGAGEMENTS;
- FINES, PENALTIES, OR DENIAL OF ENTRY IMPOSED BY BORDER CONTROL AUTHORITIES;
- VEHICULAR EXPENSES, FUEL LOSS, OR COMMERCIAL COMMODITY SPOILAGE;
- LOSS OF PROFITS, DATA, OR BUSINESS REPUTATION ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APPLICATION.
10. Apple App Store Legal Terms
Because you downloaded iBorder from the Apple App Store, you acknowledge and agree that:
- These Terms are concluded solely between you and the developer (Luis Duran), not Apple Inc.;
- Apple has no obligation whatsoever to furnish any maintenance or support services with respect to iBorder;
- In the event of any failure of iBorder to conform to any applicable warranty, you may notify Apple for a refund of the purchase price; Apple holds no other warranty obligation whatsoever;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce these Terms against you.
11. Dispute Resolution & Governing Law
- Informal Resolution: Before initiating formal legal proceedings, you agree to contact us at email to seek an informal, good-faith resolution.
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law principles.
